Special Terms & Conditions – Bluegrass Village Pointe
This auction is for the manufactured home only. No real estate is included.
The successful purchaser may elect to remove the home from the community or apply to keep the home at its current location. Approval by Bluegrass Village Pointe Management is required for any purchaser wishing to keep the home within the community. Approval is at the sole discretion of Community Management.
Current monthly lot rent is $590.00. Purchaser should verify all current and future lot rent, deposits, fees, and utility charges directly with Bluegrass Village Pointe.
If the home is to remain within the community, the purchaser shall complete all required lease application documents and satisfy all Community requirements prior to occupancy.
Per the Community Lease, a $350 inspection/transfer fee is required for homes remaining within the community. This fee is subject to Community policies.
If the purchaser elects to remove the home, all costs associated with disconnecting utilities, permits, transportation, insurance, moving, and reinstallation shall be the sole responsibility of the purchaser.
Any purchaser removing the home must provide the Community with at least 48 hours' advance notice before the manufactured home mover enters the property.
Any contractor moving the home must be properly licensed and insured in accordance with applicable law, and proof of insurance may be required by Community Management before the home is removed.
If the home remains within Bluegrass Village Pointe, the purchaser agrees to comply with all Community Lease provisions, Architectural Guidelines, and Community Living Guidelines, including those governing occupancy, maintenance, pets, vehicles, parking, and use of the premises.
The purchaser is responsible for establishing utility accounts, utility deposits, and all future utility service if the home remains within the community.
The home is sold subject to the rules, regulations, and approval requirements of Bluegrass Village Pointe Mobile Home Park.

Bidding Errors: All bids are binding and final once a lot has sold. Bids cannot be deleted or removed after a lot has closed. The Buyer is advised to review all bids on the review page prior to submission. Outbid notifications are provided as a courtesy only; the Auction Company, Seller, licensees, agents, and employees bear no responsibility for errors, omissions, or timing of outbid notices. The Auction Company reserves the right to refuse off-increment bids.
Online Bidding Disclaimer: The Auction Company utilizes third-party bidding platforms to facilitate the collection and recording of online bids. By agreeing to these terms, the Buyer agrees to hold harmless the Auction Company and all bidding platform providers for technical errors and mistakes arising from connectivity issues on the part of the Auction Company or the Buyer.
Closing: This is a single-lot auction that will close at the published time on the date specified, using a soft-close format. Any bid placed within the last 60 seconds before closing will extend the bidding period by an additional 60 seconds. This extension will repeat for as long as bidding activity continues, and the auction will only close after 60 consecutive seconds with no further bidding activity.
Buyer's Premium: A 10% Buyer's Premium applies to this online personal property purchase.
As-Is, Where-Is: All items are sold on an As-Is, Where-Is, With All Faults basis without exception. No warranty of any kind, expressed or implied, is offered as to the fitness or merchantability of any item for any purpose. Items offered may be new or used. Used items exhibit some level of wear, damage, or defect by virtue of prior use. Items represented as new may have been subject to storage, handling, display, or other conditions prior to the auction and are not guaranteed to be free of defect. The Auction Company and Seller expressly disclaim any warranty of merchantability or fitness for a particular purpose. No sale shall be invalidated by reason of any defect, inaccuracy, misdescription, or cataloging error. All marketing materials and descriptions are provided as a guide only and are not guaranteed to be complete or accurate. The Buyer holds the sole obligation and duty to inspect all items during the inspection period prior to bidding. By bidding, the Buyer accepts all items regardless of any defects or conditions, known or unknown, visible or not, and forever releases the Seller, the Auction Company, licensees, employees, and agents from any and all claims. No bids may be withdrawn during or after the auction for any reason. These terms may only be amended by written agreement signed by the Auction Company. No oral, written, or electronic representation by any party shall modify these terms.

The home may also be inspected virtually through the provided photographs and descriptions. By bidding, the Buyer acknowledges having had a full and fair opportunity to inspect the home and agrees to rely solely on the Buyer's own inspection, whether in person, through a proxy, or based on provided photographs, in determining whether and how much to bid.
Removal / Occupancy of the Home: Within 30 days of the auction closing date, the Buyer must either (a) remove the manufactured home from Bluegrass Village Pointe, or (b) obtain written approval from Bluegrass Village Pointe Management to keep the home at its current location and satisfy all Community lease and occupancy requirements. See the Special Terms & Conditions – Bluegrass Village Pointe section above for the requirements governing removal or continued occupancy of the home.
The Auction Company does not arrange or provide moving, transportation, disconnection, reinstallation, or storage services for the home. All such arrangements, and all associated costs, are the sole responsibility of the Buyer. The Buyer is solely responsible for coordinating with a licensed and insured manufactured home mover, obtaining any required permits, and providing Bluegrass Village Pointe with at least 48 hours' advance notice before the mover enters the property.
If the home is neither removed nor approved by Bluegrass Village Pointe Management for continued occupancy within the 30-day period, the home will be considered forfeited as set forth below.
Forfeiture / Default: Forfeiture is defined as the Buyer's relinquishment of all ownership and claim to the home to the Auction Company with no expectation of reimbursement. If the Buyer fails to pay the remaining balance in full within 30 days, or fails to either remove the home or obtain approved occupancy from Bluegrass Village Pointe Management within 30 days of the auction closing date, the Buyer will be in default and the home will be considered forfeited. A Buyer who forfeits the home remains fully responsible for the total invoice amount, and the down payment will not be refunded. No further refunds will be issued in the event of forfeiture. The Buyer who wishes to formally forfeit the home must contact the Auction Company on or before the 30-day deadline.
Payment: A down payment equal to 10% of the total purchase price (hammer price plus Buyer's Premium) is due immediately upon the close of the auction and will be charged automatically to the credit card on file. If the card is declined, the Buyer will be contacted promptly to arrange payment of the down payment, and the down payment must be tendered within 24 hours. The remaining balance is due in full within 30 days of the auction closing date. Balance payments may be made by cashier's check, money order, wire transfer, or business/personal check with valid photo identification and Auction Company approval. Business or personal checks of $10,000.00 or more must be accompanied by a Bank Letter of Credit. Cash payments are discouraged. Title and possession of the manufactured home will not transfer to the Buyer until the balance has been paid in full.
Title: The title (or certificate of origin, as applicable) for the manufactured home will be delivered to the Buyer within 10 to 15 business days following receipt of payment in full. Bank-held titles may require up to 30 business days to process.
Choice of Venue / Jurisdiction: By registering to bid and accepting these terms, the Buyer agrees and consents to the exclusive jurisdiction and venue of the Circuit Court of Harrison County, West Virginia for all disputes arising out of or related to the auction process and sale. The Buyer waives all jurisdictional and venue defenses and affirmatively submits to the exclusive jurisdiction of that Court.
