Terms, Conditions and Expenses of the Sale:   Details of terms of sale and procedures for submitting bids are online at Bidding closes on January 27, 2022 at 6:00 pm local time.  Successful bidder will execute enforceable written real estate purchase contract and shall deposit a 10% non-refundable down payment equal to 10% of the final bid price by wire transfer within 24 hours of the close of auction. Wiring instructions will be supplied to high bidder immediately after close of auction.    Credit cards are not accepted.  Deposit will forfeit to Trustee if closing fails for any reason other than seller default.  Sale closes no later than 30 days after conclusion of the auction unless Seller otherwise agrees. If Buyer defaults, Trustee may, but is not required, to proceed to close sale to second highest bidder without further notice.  No financing or other contingencies in Buyer’s bid or contract will be accepted. 


Any desired inspection must be done prior to bidding.  Property is sold as is where is with no warranty written or implied.    Transfer will be by deed with fiduciary covenants only.  Seller is conveying surface rights only with no oil, gas, coal, mineral, or other subsurface interests conveyed unless otherwise noted.   In addition to bid, Buyer will pay 10% Buyer’s Premium added to final bid price.  Seller will disburse Buyer’s Premium to Realtors as compensation at closing without further order.  Name of purchaser on contract and deed must be the name of the winning bidder or an entity which the winning bidder legally represents   No exceptions.


Liens and Encumbrances:  Property is free of liens other than delinquent and current real estate taxes that Trustee will pay or pro rate at closing.  No exemption is owed to the Debtor and nothing will be paid to Debtor from the proceeds of Property.
