TERMS OF SALE: Said real estate and other property will be sold for cash in hand due immediately at the conclusion of the auction and sale. With Lender approval and consent, Bidder may pay a fifteen percent (15%) nonrefundable down payment to the Trustee immediately at the conclusion of the auction and sale, with entire balance of the bid to be due and payable within thirty (30) days from the date of the sale (no exceptions). In addition to the high bid which may be accepted at the time of the auction and sale, the Purchaser shall also be responsible for and pay a ten percent (10%) nonrefundable “Buyer’s Premium”, calculated on the amount of the high bid, directly to the Joe R Pyle Auction Service, due immediately at the conclusion of the auction and sale. All persons intending to be present at said time and place of auction and sale, and intending to bid, must register with Trustee, showing a valid proof of identity and evidence of source of funds or bank letter authenticating credit availability in amounts equivalent to any proposed bid, plus costs and fees. All bids may be freely assigned to qualified parties or entities, subject to Lender’s consent. Purchaser shall pay all costs of the auction and sale, including without limitation, transfer tax stamps, property taxes, advertising, recording costs, deed preparation closing costs, and attorney fees incurred pursuant to said bid, purchase, transfer, and sale. Costs and fees will be announced at the auction and sale and are not limited to the above. The undersigned Trustee reserves the right to continue said auction and sale from time to time and to reject any and all bids or offers at any time.
